Czech Republic's Populist Prime Minister-Elect Refuses to Divest Business Empire Amid Ethical Dispute

Andrej Babiš, the self-styled tycoon that won last month's parliamentary vote, has refused to offload his vast business interests, while insisting he will resolve a ethical dilemma that could prevent him from assuming the position of prime minister.

Stance on Corporate Empire

Babiš, whose political movement came first in the October election but lacked a parliamentary majority, declared in a social media post that he would not sell his Agrofert conglomerate, which operates in agriculture, food production, and chemicals.

“I have repeatedly said I will never sell Agrofert. I have repeatedly stated I will address the conflict of interest in compliance with national and EU regulations,” the billionaire remarked. “This is different from selling a pastry in a bakeshop.”

President's Requirement

The Czech president, Petr Pavel, stated that the 71-year-old political figure must publicly explain how he will remove conflicts of interest arising from his corporate dealings before being appointed premier.

The national charter “explicitly requires the head of state to take into account the possible emergence of a ethical issue and the possibilities for its resolution” when appointing government ministers, Pavel's office explained.

The president “expects clarity in what specific way Andrej Babiš will fulfil his constitutional and legal obligations”, the statement added, noting that Pavel was prepared to appoint Babiš as premier “immediately” once the matter was resolved.

Corporate Activities and Legal Issues

Babiš's numerous companies, mostly under the Agrofert group, operate in the Czech Republic and other central European countries, benefiting from substantial funds in domestic and European farming and other subsidies, as well as public contracts.

Under national legislation, government ministers are barred from receiving state support or agreements. The anti-corruption organization Transparency International has indicated that to avoid a conflict of interest, Babiš must either sell, refuse government deals, or stay out of government.

Past Tenure and Current Plans

Babiš said he would “follow the laws” if selected as premier, but declined to detail how in beforehand because the issue was “an highly personal and personal matter for me, and the media will always criticise me anyway”.

During his initial tenure as premier, from 2017 to 2021, Babiš faced several legal battles and an EU investigation over potential ethical issues. He temporarily moved his holdings into trust funds, while retaining certain control over them.

A judicial body and the European Commission both ruled that this was insufficient. Babiš stated recently that he was again the exclusive proprietor of Agrofert and insisted he was “implementing measures” to prevent a conflict of interest, but declined to reveal details.

Coalition Deal and Foreign Policy Consequences

The wealthy politician has concluded a governing pact with two rightwing fringe parties, the ultra-conservative, Russia-friendly SPD, which has advocated a public vote on leaving the EU, and the Motorists for Themselves, which has primarily opposed the EU’s environmental policy.

The incoming administration, if approved, is likely to strengthen the populist movement in central and eastern Europe and might challenge backing from Western nations for Ukraine – even though Babiš has contacted Ukraine’s leader, Volodymyr Zelenskyy, to assure him of Czech support.

Pavel, who as president shares responsibility for foreign policy, also requested that the coalition’s programme include a statement on the government’s position on the conflict in Ukraine, including a commitment to meeting Nato obligations.

The president has earlier stated he would not endorse any ministerial nominees who might doubt the Czech Republic’s EU and Nato commitments, a condition that the far-right SPD has said it will satisfy by nominating non-partisan experts.
